Cooperatives: a legal model suited to the collaborative economy? How to take into consideration the growing need for legal frameworks adapted to collaborative structures.

Is the cooperative company structure the most suitable legal framework for the development of a collaborative activity?

Is the current legal system of cooperatives sufficient as a legal form to encourage the emergence of collaborative activities or should there be a reform?

The current reform of the Companies Code amends certain characteristic aspects of cooperatives and leads one to think that the federal legislature has genuinely not pondered the need for a suitable collaborative structure. Is it the duty of the legislature to propose adapted legal forms, where necessary simplified or regulated as is the case for companies with a social purpose? Or will collaborative business be able to easily develop based on existing law with no further requirements, whether collaborative interests have been taken into account or not? Is a cooperative the best system to allow for the development of collaborative commons?
